Question I got married 7 yrs ago and have two children. in our nikahnama he has given me the right of divorce (talaaq ka haq tafweez kiya)when we got married my husband told me he had alcoholic drinks a few times a few yrs ago i told him if he drinks again our talaaq will happen.he agreed to it. i just came to know he had drinks about 2 yrs ago when he was traveling abroad. my question is - are we divorced? is it counted as one divorce? -what if he had drank more than once? would it count as one divorce each in case he drank thrice? -what does it mean to have the right of divorce? -is the period of these 2 yrs we have been living as husband wife was living in sin? -is there a way of reconciliation or kuffara? 
Answer Is terah talaaq nahi hoti.wo aap k shohar hi rahain gay.or aap ko koe kaffarah nahi daina hay.kun k Fiqh e jaafriya(Shia) main talaaq ki chand shartain hain jin ki pabandi nah ki jaay tu talaaq nahi hoti. 1.talaq k waqt aurat haiz or nifaas say paak ho or is paaki k doran merd nay jima(intercourse) nah kia ho. 2.talaq zabani dijaay.yani likh ker talaq dayna batil hay or talaq nahi kehlaay gi. 3.zarori hay k talaq arbi zaban main di jaay. 4.talaaq do adil(jo zaahiran gunahgaar nah hoon,or wajib kaamo per amal kertay hon or haram kaamo say bachtay hon) gawahoo ki maujoodgi main di jaay. 5.Talaaq k waqt talaq ki niyat ho,layhaaza agar wo maslan mazaaq ya nashay ki halat main talaq day tu,talaaq sahi nahi hogi.(ref:Ayat Ullah Seestani(d.b), Tauzee hul masail, maslah# 2462 to 2464 & pg#460)
