Question ID
Mujtahid Name -- None --
Question QUESTION: If a man had sexual intercourse with a woman during her pure period and divorces her during the same period, and then marries temporarily and again permanently her sister after only two pure periods but in the middle of her 3rd menses after the divorce, (and it transpires later that the woman was not pregnant at the time of divorce), is that divorce in order and the 2 marriages to the sister also in order? And if either the divorce or the marriages are void, what should be done next? FOR EXAMPLE: On the 3rd of February a man divorced his wife during her pure period in which they indeed had intercourse. She then had a menses from the 16th-23rd of February, became pure once, had a menses again from the 12th-19th of March, then became pure a second time. She then had her 3rd menses after the divorce from the 3rd-10th of April, during which the man married (temporary) his divorced wife’s sister on the 5th of April and then again married (permanent) (his divorced wife’s sister) on the 9th of April. Are the divorce and the two marriages to the divorced wife’s sister all in order? If not, what should be done next?
Answer Your divorce is not valid. And your sister marriage also invalid. (Ref:Ayat Ullah Seestani(d.b), Tauzee hul masael,Edition# 35,Mafhoom e Maslah #2463,2355). Update on dated 29-08-2015. (Khuda aap ko Uloom e Aal e Muhammad(s.a.w.w) sekhne ka ajar ata farmaey).
